Question(s):
My husband gave me a Talaq. Please could you advise regarding the ruling of maintenance for the children and for me. One of our children is a disabled young adult.

Answer(s):
In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The husband is solely responsible for the maintenance expenses of the wife during the Iddah (waiting period), not thereafter.

As for the children, generally the father is responsible for the male child’s maintenance expenses (unless he has enough wealth himself) until he is baligh (mature) and the female child’s maintenance expenses until she is married.

Nonetheless, if a particular child is unable to earn a livelihood by himself eg. due to disability etc, then the father must continue to provide for his expenses, even after the child’s maturity.

قوله (ولقريب محرم فقير عاجز عن الكسب..) أي تجب النفقة للقريب إلى آخره…وأما البالغ الفقير فلا بد من عجزه بزمانة أو عمو أو فقظ العينين أو شلل اليدين أو مقطوع الرجلين أو
معتوه أو مفلوج.
