If one has to call somewhere and they are put on hold where music is played, what is the ruling of this music when one doesn’t intend to listen to it? Will one be sinful for this?

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If one needs to call a line that has music installed which one hears unintentionally when they are put on hold etc, then one will be regarded excused and thus, will not be deemed sinful

قال ابن عابدين في رد المحتار (٦/٣٩٥، الفكر): وإن سمع بغتة يكون معذورا ويجب أن يجتهد أن لا يسمع. انتهى. وهذا قال الموصلي في الإختيار (٤/١٦٦، الحلبي)

وقال الزيلعي في تبيين الحقائق (٦/١٤، بولاق): ولو سمع بغتة فلا إثم عليه. انتهى

وقال الملا علي القاري في مرقاة المفاتيح (٣/١٠٦٦، الفكر): (وإن سمع بغتة فلا إثم عليه) لأنه أمر إيجابي لا اختياري (ويجب عليه أن يجتهد كل الجهد) يعني يصرف جهده ووسعه وطاقته (حتى لا يسمع لما روي أن «رسول الله – صلى الله تعالى عليه وسلم – أدخل أصبعيه في أذنه» انتهى. وكذا قال أبو سعيد الخادمي الحنفي فی بریقة المحمدية (٤/٥٢، الحلبي)

وقال المفتي سلمان منصورفوري في كتاب النوازل (١٧/٩٧، مكتبة جاويد): اگر کسی شخس کو ایسے آدمی سے رابطہ کی ضرورت پڑے جس نے موبائل میں گانا فیڈ کر کرھا ہو اور اس بنا پر رابطہ کرنے والا بلا ارادہ مجبورا گانے کی آواز سن لے، تو وہ گنہگار نہ ہوگا۔ انتھی
