Are the DFC Pasha Waterproof Wudhu Socks Shari’ah Compliant? Is Masah valid with them?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, for Masah to be valid on such socks, they must fulfil the following criteria:
1) They should be durable enough that a person can walk with the sock for approximately three miles without them tearing.
2) The socks should remain on the leg without them being tied or fastened.
3) They should be such that water does not seep through them.

We have personally examined the ‘Pasha Waterproof Socks’ and are satisfied that they fulfil all the above-mentioned conditions. Hence, it is permissible to use the ‘Pasha Waterproof Socks’ and make Masah on them for Wudhu. The general guidelines of Masah on leather socks will apply.

The Pasha Socks in question have been identified as ‘Thakhinayn’ [thick socks]. Accordingly, the 3 principles outlined in the Fatwa above have been applied and found to be fulfilled. Below, we have briefly indicated the basis of all 3 principles; nonetheless, they are well-known and can be found across many Hanafi Fiqh Sources and Fatwas issued globally. قال: (الثخينين) بحيث يمشي فرسخا ويثبت على الساق ولا يرى ما تحته ولا يشف
وقال ابن عابدين: وفي بعض الكتب: ينشف بالنون قبل الشين، من نشف الثوب العرق كسمع ونصر شربه قاموس، والثاني أولى هنا لئلا يتكرر مع قوله تبعا للزيلعي ولا يرى ما تحته، لكن فسر في الخانية الأولى بأن لا يشف الجورب الماء إلى نفسه كالأديم والصرم، وفسر الثاني بأن لا يجاوز الماء إلى القدم

اس عبارت سے معلوم ہوا کہ جواز مسح علی الثخینین کے لیے ثخانت کا وجود ضروری ہے جو کہ امورِ ثلاثہ سے متحقق ہوتا ہے: ۱) شرعی تین میل یا اس سے زیادہ بغیر جوتے کے آدمی اس میں چل سکے، ۲) باندھے کے بغیر پنڈلی سے پیوست رہیں۔ ۳) پانی اگر اس پر ڈالا جاۓ تو اندر نہ جاسکے۔
