Someone’s father had passed away 19 years ago and he left behind some money (savings in bank account). The family had no access to this money until a few days ago. Now the money has been distributed according to islamic inheritance. They knew they would receive the money eventually but didn’t know how much. The question the family are asking is, do they now have to pay zakat for the past 19 years for their share?


الجواب حامدا ومصليا ومسلما

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, the inheritance that one has no access to will be considered as a weak debt. Accordingly, Zakāt is only due on this wealth once it comes into one’s possession (or one has access) and there is no need to pay Zakāt for the period where there was no access to the wealth. [1]

In the scenario in question, since the family gained access only a few days ago, there is no need to give Zakāt for the previous 19 years where there was no access.

واما الضعيف فهو مال غير بدل عن مال مثل مهر المرأة والصلح من دم العمد والسعاية والميراث والوصية ونحوها فهذا ليس عليه زكاة ما مضى فاذا خرج منه ما يكون نصابا ثم حال عليه الحول فعليه الزكاة وهي سواء كلها عند ابي حنيفة ومحمد فإذا خرج منه شيء فانه يزكي لما مضى بعد ان يكون الدين نصابا كاملا وحال عليه الحول

وفي الدين الضعيف لا تلزمه الزكاة ما لم يقبض ويحول الحول عنده

وأما الدين الضعيف فهو الذي وجب له بدلا عن شيء سواء وجب له بغير صنعه كالميراث، أو بصنعه كما لوصية، أو وجب بدلا عما ليس بمال كالمهر، وبدل الخلع، والصلح عن القصاص، وبدل الكتابة ولا زكاة فيه ما لم يقبض كله ويحول عليه الحول بعد القبض

زید کا مال والدین اور بھائی کے قبضہ میں رہا اب اس کے تصرف میں آیا وہ زکاة کب سے دے
جواب: آئندہ کو جب کے اس کے قبضہ میں مال آیا ہو زکاة ادا کرے گزشتہ زمانہ کی لازم نہیں

دوسری روایت یہ ہے کہ دین متوسط پر زکاة فرض نہیں، بلکہ دوسو درہم وصول ہونے کے بعد سال پورا ہونے پر زکاة فرض ہوگی، گزشتہ سالوں کی زکاة نہیں، یہ روایت راجح ہے۔
دین ضعیف : وہ دیں جو مال کے عوض میں نہ ہو-اس پر وصول سے قبل زکاہ فرض نہیں، بعینہ وہی حکم ہے جو دین متوسط کے روایت ثانیہ میں گزرا۔
